Pacific L. A. Marine Terminal LLCs commitment to the reduction in emissions described here is sealed by more than corporate commitment or Port requirements. The Pier 400, Berth 408 Projects facility is uniquely regulated by the SCAQMD (see website section on SCAQMD). This unique regulatory situation gives SCAQMD enforcement authority that it does not normally have at other Port facilities. The commitments Pacific L. A. Marine Terminal LLC (detailed above) makes will become part of a SCAQMD permit to operate. Inherent in the permit will be permit conditions. One set of conditions will include emissions limitations on the facility, effectively capping emissions to the levels committed to by Pacific L. A. Marine Terminal LLC. The SCAQMD, as a regional enforcement authority of clean air, will require Pacific L. A. Marine Terminal LLC to demonstrate on a monthly basis that it is complying with these emission limitations. This monthly demonstration essentially ensures that Pacific L. A. Marine Terminal LLCs corporate commitment to being a good neighbor to the Port community is met. Pacific L. A. Marine Terminal LLC welcomes this level of control and has been actively working with SCAQMD to develop appropriate verification techniques.
